Community Contribution Licensing Policy
Introduction
This Community Contribution Licensing Policy (“Policy”) sets forth the legal terms and conditions governing the submission, use, and distribution of contributions on the platforms operated by Androidacy LLC (“Androidacy”). Contributions may include, but are not limited to, code, form submissions, files, ideas, and other materials (collectively, “Contributions”). This Policy complements our General Terms of Service and Privacy Policy and is governed by the laws of the United States.
Commitment to Intellectual Property Rights
Androidacy is committed to respecting and upholding the rights of authors and creators, recognizing the value and importance of their intellectual contributions. We affirm that we have never and will never knowingly engage in activities that infringe upon such rights. If any party believes that their intellectual property rights have been compromised via our platform, we encourage prompt communication of their concerns through our Contact Page.
Section 1: Contributors of Contributions
- Warranties and Representations: Individuals or entities submitting Contributions to Androidacy (“Contributors”) represent and warrant that they are the creators of the Contributions or have obtained all necessary permissions, licenses, and consents from the creators (“Creators”) to submit such Contributions. Contributors further represent that their Contributions do not infringe upon or violate the intellectual property rights, privacy rights, or any other rights of third parties.
- Grant of License: By submitting Contributions to Androidacy, Contributors grant Androidacy a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license, without limitation, to use, reproduce, adapt, publish, translate, create derivative works from, distribute, perform, and display such Contributions in any media now known or hereafter devised, unless otherwise required by law. This license does not infringe upon or revoke any existing licenses held by others or the ownership rights retained by the Contributors or Creators.
- Right to Refuse Contributions: Androidacy reserves the right, at its sole discretion, to refuse, reject, or remove any Contribution submitted to our platforms without prior notice or liability.
- Licensing Terms Compliance: If a Contributor includes specific licensing terms with their Contribution, Androidacy may, at its sole discretion, choose to comply with such terms. Licensing terms that Androidacy will not or cannot comply with will result in the Contribution being rejected.
- Additional Terms: Any additional terms or conditions proposed by Contributors that conflict with this Policy, our General Terms of Service, or applicable law are null and void and are not legally binding unless required by applicable law.
- Indemnification: Contributors agree to indemnify, defend, and hold harmless Androidacy, its affiliates, officers, directors, employees, agents, and assigns from any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to the Contributor’s breach of any representations or warranties set forth in this Section.
Section 2: Creators of Contributions
- Intellectual Property Ownership: Creators retain all proprietary rights, including copyrights and trademarks, in their Contributions. Submission of their Contributions to Androidacy’s platforms does not transfer ownership of their intellectual property. By submitting their Contributions, Creators grant Androidacy the same limitless, perpetual license as outlined in Section 1, unless otherwise required by law, without infringing upon others’ licenses or revoking their own rights.
- Attribution and Moral Rights: Androidacy commits to providing appropriate credit to Creators whenever their Contributions are used within our platforms, consistent with industry standards and the Creators’ expressed preferences, while also respecting their moral rights as recognized by applicable law.
- Specific Licensing Terms: If a Creator’s Contribution is governed by specific licensing agreements (e.g., open-source licenses), the Creator must provide clear and conspicuous notice of such terms at the time of submission. Androidacy may, at its sole discretion, choose to comply with these specific licensing terms but does not guarantee adherence to them. Licensing terms that Androidacy will not or cannot comply with will result in the Contribution being rejected.
- Additional Terms: Any additional terms or conditions proposed by Creators that conflict with this Policy, our General Terms of Service, or applicable law are null and void and are not legally binding unless required by applicable law.
- Disclaimer of Liability for Unauthorized Submissions: Creators acknowledge and agree that Androidacy is not responsible or liable for any unauthorized submission, infringement, or misuse of a Creator’s Contributions by third parties. Creators cannot hold Androidacy responsible for illegitimate submissions of their Contributions, except as required by law. Creators may request the removal of their Contributions, which Androidacy may comply with at its discretion or as required by law.
Section 3: Users of Contributions
- License Compliance: Users accessing Contributions through Androidacy’s platforms (“Users”) are obligated to adhere to the terms of the specific licenses under which such Contributions are distributed. Users must review and understand these terms prior to any use.
- Usage Restrictions: Unless expressly authorized by the specific license of a Contribution, Users are limited to personal, non-commercial use of the Contributions. Any commercial exploitation, redistribution, or creation of derivative works without proper authorization is strictly prohibited.
- Prohibition of Unauthorized Activities: Users are expressly prohibited from engaging in any form of unauthorized reproduction, modification, distribution, public display, or performance of the Contributions accessed through Androidacy’s platforms.
Advertising and Revenue Generation
- Advertisements: Androidacy incorporates advertisements within its services to defray operational expenses. These advertisements comply with all applicable standards and laws and are not mechanisms for monetizing the intellectual property of others. Advertisements shall not be construed as monetizing others’ works or intellectual property. Androidacy will not inject or input advertising into the Contributions of Creators outside of our platforms.
- Non-Endorsement: The inclusion of any Contribution within Androidacy’s platforms does not imply endorsement by Androidacy of any products or services advertised therein. Similarly, the presence of advertisements does not imply any endorsement of the Contributions by the advertisers.
General Provisions
- Right to Refuse Contributions: Androidacy reserves the right, at its sole discretion, to refuse, reject, or remove any Contribution submitted to our platforms without prior notice or liability.
- Additional Terms: Any additional terms or conditions proposed by Contributors, Creators, or Users that conflict with this Policy, our General Terms of Service, or applicable law are null and void and are not legally binding unless required by applicable law.
- Policy Modification: Androidacy reserves the right to modify or amend this Policy at any time. Such modifications will become effective immediately upon posting the revised Policy on our website. Continued use of our platforms following the posting of changes constitutes acceptance of those changes.
- Governing Law and Jurisdiction: This Policy shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the federal and state courts located within the United States.
- Severability: If any provision of this Policy is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
- Assumption of Good Faith and Limitation of Liability: Androidacy operates under the assumption that all Contributions are made in good faith. However, Androidacy disclaims all responsibility and liability for Contributions, including but not limited to any unauthorized or illegitimate third-party submissions, except as required by law. Creators and Contributors cannot hold Androidacy responsible for illegitimate submissions of their Contributions, except as required by law. To the maximum extent permitted by applicable law, Androidacy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to this Policy or the use of our platforms.
- Content Removal Requests: Creators may request the removal of their Contributions from our platforms. Androidacy may, at its sole discretion, comply with such requests or as required by law.
